GENERAL INFORMATION AND SPECIFICATIONS FOR PROSPECTIVE CONTRACTORS SUBMITTING QUALIFICATIONS AND PROPOSALS FOR CONTRACT FOR POSITION OF BOROUGH ENGINEER
I. Invitation to Submit Qualifications and Proposal.
The **Borough of West Wildwood** is requesting qualifications and proposals from individuals and/or firms for a contract for either a **one-year appointment or a three-year appointment** for **Borough Engineer**, pursuant to N.J.S.A. 40A:9-140[cite: 3, 4]. The solicitation is through a fair and open process in accordance with N.J.S.A. 19:44A-20.5, et. seq[cite: 4, 5].
II. Submitting and Delivery of Qualifications and Proposals.
Qualifications and proposals must be submitted on or before **December 23, 2025**[cite: 7]. They may be submitted either by mail or in person by the prospective contractor or his agent[cite: 7]. Proposals must be enclosed in a **sealed envelope** plainly marked “**Qualifications and Proposal for Borough Engineer Contract**” and must also include the name and address of the prospective contractor[cite: 8, 9].
III. Time and Place for Acceptance of Qualifications and Proposals.
The West Wildwood Borough Clerk is authorized to receive all qualifications and proposals[cite: 11].
All sealed proposals must be submitted to:**Borough Clerk, Borough of West Wildwood**701 W. Glenwood Avenue, West Wildwood, New Jersey, 08260 [cite: 12]The submission deadline is **December 23, 2025, at 10:00 a.m., prevailing time**[cite: 12]. No proposal will be received after the designated time[cite: 14].
IV. Contract Description; Qualifications; Proposal.
a. Contract Description.
The Borough Engineer shall perform all services customarily performed by an Engineer of a Borough the size of West Wildwood (accounting for permanent and seasonal population)[cite: 16].
Such services include, but are not necessarily limited to, the following[cite: 17]:
- Prepare feasibility studies as requested by the Borough[cite: 19].
- Perform all necessary field work and prepare drawings and surveys for Borough capital improvement projects[cite: 20].
- Prepare plans and specifications for public bidding and to describe the work to be performed by the contractor[cite: 24].
- Assist the Borough in preparing necessary applications/permit forms for submission to proper governmental agencies[cite: 26]. *The Borough Engineer is not responsible for any failure to issue, delay, or conditions imposed by such governmental agency*[cite: 27].
- Assist the Borough in the receiving, analyzing, and tabulation of bids with recommendations[cite: 28].
- Compile sets of contracts, obtain performance bond and signatures, and forward contracts to the Borough for approval[cite: 29, 30].
- Furnish observation of work as to **progress and general quality**[cite: 31]. *However, the Borough Engineer is NOT responsible for supervising the contractors, overseeing their means/methods, job site safety, or their failure to properly perform their work*[cite: 32].
- Review and approve or disapprove shop drawings only for the limited purpose of checking for the **design concept**[cite: 33]. This review does not determine the accuracy of details (dimensions, quantities) or constitute approval of safety precautions[cite: 34, 35].
- Report on contractor’s change order requests, submit recommendations, and prepare change orders as approved[cite: 36].
- Prepare and submit **monthly certificates for interim payments** and a **final certificate** stating that, based on observations, the Contractor performed in accordance with the plans, specifications, and change orders[cite: 37, 40].
- Furnish **full time resident inspection** if authorized, consisting of: (1) reporting on progress and noting observed defects, deficiencies, or unnecessary delays (without guaranteeing the work)[cite: 41]; and (2) approving of materials and equipment furnished[cite: 42].
- Furnish copies of plans and specifications: One set for Borough during bidding[cite: 45], three sets to City for preparing contracts[cite: 47], and two sets to State and/or Federal Agencies for approvals[cite: 49]. All other copies must be furnished at cost of reproduction[cite: 50].
- Attend Borough meetings when contractor’s proposals are to be accepted[cite: 51].
- Perform other planning services upon authorization, including hydrographic surveys, property surveys, easement surveys and descriptions, and assisting with litigation or negotiation[cite: 52, 53].
- Maintenance of all Borough maps[cite: 70].
b. Qualifications.
The contractor must possess all required **State of New Jersey licenses or certifications**[cite: 71]. The Borough Engineer must be a **duly licensed professional engineer** in New Jersey in accordance with N.J.S.A. 45:14A-1, et. seq[cite: 72, 73]. Resumes or curricula vitae of all individuals performing services must be submitted with the proposal[cite: 74].
c. Proposal.
The proposal must **clearly set forth the proposed financial compensation**[cite: 75].
V. Selection Process & Award of Contract.
Proposals will be reviewed by a committee (Borough Administrator, one Commissioner, and Borough Solicitor) and evaluated on the basis of the most advantageous, considering price and other factors[cite: 78, 79].
Evaluation Factors:
- Experience and reputation of the prospective contractor in the field[cite: 83].
- Knowledge of the Borough of West Wildwood and issues unique to it[cite: 84, 85].
- Availability to accommodate any required meetings[cite: 86, 87].
- Compensation proposal[cite: 90].
- Other factors demonstrated to be in the best interest of the Borough[cite: 91, 92].
The Board of Commissioners may award the contract on or about **January 2, 2026, by resolution**[cite: 96].
VI. Obligation of Prospective Contractor.
The contractor is presumed to have read and be familiar with the contents of both the Notice of Availability and this document[cite: 97]. Failure to examine either document does not relieve the contractor from any obligation[cite: 98].
VII. Investigation of Qualifications.
The Borough may make necessary investigations to determine responsibility, and the contractor must furnish all requested information[cite: 99]. The Borough reserves the right to reject any proposal if the investigation fails to satisfy them that the contractor is properly qualified[cite: 100].
VIII. Signing of Proposal Documentation.
The documentation must be signed by the individual or on behalf of the entity to be bound by the contract[cite: 101].
IX. Mandatory Certifications.
a. New Jersey Business Registration Certificate (BRC)
Contractors must provide a copy of their BRC **prior to award** of a contract[cite: 105]. It is **strongly recommended** that a copy is included with the proposal submission[cite: 106, 110].
b. Ownership Disclosure Statement
Required by N.J.S.A. 52:25-24.2[cite: 112, 113], setting forth the names and addresses of all stockholders/partners/members who own **10% or more interest**[cite: 113]. A form is annexed[cite: 114].
c. Disclosure of Investment Activities in Iran
Required by P.L. 2012, c.25 and N.J.S.A. 40A:11-2.1[cite: 116], certifying that the entity is **not** on the N.J. Treasury’s “Chapter 25 List” of entities engaging in prohibited investment activities in Iran[cite: 116]. A Certification is annexed[cite: 117].
d. Certification of Non-Involvement in Prohibited Activities in Russia or Belarus
Required by N.J.S.A. 52:32-60.1, et seq.[cite: 118], indicating whether the Vendor is engaged in prohibited activities in Russia or Belarus[cite: 233]. The Department of the Treasury may impose sanctions or seek debarment for violations[cite: 120, 234]. A Certification is annexed[cite: 121].
X. Miscellaneous.
- a. The Borough reserves the right to award the contract using **non-fair and open procedures** (N.J.S.A. 19:44A-20.5, et. seq.) if deemed in the Borough’s best interests[cite: 126, 127, 128].
- b. All contracts shall be governed by and interpreted in accordance with the **Laws of the State of New Jersey**[cite: 130].

XI. Proposal Documents Checklist.

Where a form is provided, prospective contractors must **utilize the form supplied, and substitutions will not be accepted**[cite: 146]. Extra pages must be attached if more space is needed[cite: 147].
